At a Mammoth Town Council meeting held May 14, 2013, two former Mammoth Police Officers questioned their termination during the call to the public. Hector Hernandez said he had resigned under duress saying that Police Chief Marty McIntosh told him it would look bad on his record if he fired him. Daniel Maggio complained that McIntosh had questioned him about wages he had received while collecting unemployment from the state of Idaho and had accused him of fraud.
On Sept. 18, 2013 the Arizona Peace Officers Training and Standards Board (AZ POST) voted to initiate proceedings concerning Daniel Maggio and issues that resulted in his termination while working for the Mammoth Police Department. On Dec. 13, after considering comments made by Assistant Attorney General Diana Stabler and Daniel Maggio, Deputy Director Young made a motion to adopt the consent agreement, decision and order and revoke Maggio’s Peace Officer Certification. The motion was carried unanimously. Revocation of a Peace Officer Certification means the permanent withdrawal of certified status and that Maggio will not be able to work as a police officer. Details of the allegations against Maggio were not made available on the AZ POST website nor were the comments made by the assistant attorney general and Maggio at the hearing.
