In its continued opposition to Curis Resources and its Florence Copper Project, the Florence Town Council unanimously passed a measure on Mar. 4 that puts forth efforts to acquire 1,200 acres of private land owned by Curis Resources through eminent domain. Curis officials said the move would hurt taxpayers and stood no chance of standing up in court.
The ordinance classified Curis’ usage as a “claimed legal non-conforming” use of the property. Among the purposes for the ordinance were the acquisition of water rights for land and prepare a site for a future wastewater treatment plant.
Shane Ham, a Curis lawyer, told the council the ordinance would not meet the criteria for eminent domain and argued legal costs for such an effort would be put toward taxpayers.
