Florence – On Fri., Nov. 15, Robert Villalobos, 26 of Superior, was arraigned and plead not
guilty to eight felony counts in Pinal County Superior Court, including attempted first degree murder. Shortly thereafter, three more individuals: Kim Magallanez, 41, Evelyn Estrada, 43, and Eduardo Apodaca, 26, were arraigned and plead not guilty after being charged for their alleged involvement with the same incident and also face multiple felony charges to include attempted first degree murder and armed robbery.
The Probable Cause statement indicates that, on Oct. 26, Superior Police Department and Pinal County Sheriff’s Deputies responded to and investigated an assault and gunshot wound reported on Quail Road in Superior. Shortly after initial reports of the gunshot victim, law enforcement received a call to the desert-area near Highway 177 and Arnette Road to a vehicle fire. The vehicle was later identified as being that of the gunshot victim, according to the Form 4.
The Probable Cause Statement alleges the victim was lured to an area near the ball fields in Superior, shot in the neck, driven to a desert-area, beaten and left there.
Villalobos has been charged with Armed Robbery of the gunshot victim and Misconduct Involving a Weapon. Additionally, he faces charges of Attempted First Degree Murder, Arson of a Structure. Also, upon execution of the search warrant, the Probable Cause statement alleges police found what are believed to be methamphetamine and drug paraphernalia, which resulted in charges of Possession of a Dangerous Drug and Possession of Drug Paraphernalia. Six of the eight felony charges Villalobos faces include additional allegations of being dangerous.
Outside of one count, Apodaca, Magallanez, and Estrada face identical charges to include Attempted First Degree Murder, Aggravated Assault with a Deadly Weapon, Kidnapping, Armed Robbery and Arson of a Structure, all charges carrying a dangerous allegation. Apodaca, additionally, faces one count of Misconduct Involving Weapons.
All four individuals are presumed innocent until and unless proven guilty.
Pinal County Attorney Lando Voyles stated, “No victimless crime exists when involving illegal drugs. Drugs and violence coexist as do turkey and Thanksgiving dinner. From marijuana to meth, we continue to see the violence bred from these substances and my office and law enforcement will continue to fight the danger they pose on our Pinal families.”
